A forfeiture occurs if a defendant fails to appear in court as scheduled.
A premium is the amount paid to a bail bonds company for the many services and financial risks assumed by that company, on behalf of the defendant. The amount of the premium is usually 12% of the amount of the bail which covers all fees.
As per state law, a bail agent charges the amount of the premium.
A bond is in effect until the defendant completes his obligations to the court.
Collateral is usually supplied by relatives or friends of the defendant and provides added financial security to ensure the defendant appears in court.
This is considered a "forfeiture". (see 1st question)
No. The premium is for the services provided by the Bail Bonds Company to release the defendant from jail and to make sure he appears in court on the scheduled day. Even if the charges are dropped, the premium is NOT refunded.
